Terms of Service

1. The Service

Our Big Yes provides couples with tools to create a wedding website, manage guest RSVPs, share a gift registry, and facilitate cash gift payments via the couple's own payment gateway. The Service is intended for personal, non-commercial use in connection with a wedding or wedding-related event.

2. Accounts

• You must be 18 years or older to create an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate information when registering

3. Publishing Fee

Building your wedding site is free. To publish your site and make it accessible to guests, a one-time fee is payable: $29 (United States Dollar) for accounts outside South Africa, or R399 (South African Rand) for accounts in South Africa.

• The publish fee is a one-time charge with no expiry date and no subscription
• Your published site and its data stay live until three months after your wedding date, or until you choose to archive or delete it sooner. Section 10 sets out in full how long we keep your account and when we delete it
• Prices are quoted inclusive of VAT where applicable
• We reserve the right to change pricing for new accounts. Existing accounts that have already paid the publish fee are not affected by price changes
• Your order is sold and fulfilled by Paddle.com Market Ltd, our authorised reseller and Merchant of Record, who handles payment and refunds for the publish fee

4. Refund Policy

You may request a full refund of the publish fee within 14 days of your purchase. Refunds are handled by Paddle in accordance with the Paddle Buyer Terms. After the 14-day window has passed, the publish fee is non-refundable.

5. Cash Gifts and Payment Gateways

All gift and payment processing happens through the couple's own connected payment gateway account. Our Big Yes and Tora Technologies never hold, receive, route, or process gift funds or card data. When guests make a cash contribution:

• The payment is processed entirely through the couple's own connected payment gateway (Stripe, Paystack, Yoco, PayFast, or iKhokha)
• The funds are settled directly to the couple's gateway account by that gateway
• Tora Technologies is not a party to the gift transaction and takes 0% of any gift amount
• The gateway's own standard processing fees apply and are charged by the gateway, not by us
• Couples are responsible for ensuring their gateway account is valid and in good standing
• Any disputes about gift amounts or gateway processing must be resolved with the relevant gateway provider

By connecting a payment gateway, you confirm that you are authorised to use that account and that you comply with the gateway's own terms of service.

For payments, your relationship is with the gateway you choose. That gateway's own terms, fees, and payout rules apply to you directly, and we have no control over them. To the maximum extent permitted by law, Tora Technologies accepts no responsibility or liability for the acts or omissions of a payment gateway, including its fees, payout timing, holds or reserves placed on your funds, chargebacks, disputes, account suspensions, or availability.

6. Acceptable Use

You agree not to use the Service to:

• Post content that is false, misleading, defamatory, or illegal under South African law
• Collect personal information from guests beyond what is needed for legitimate wedding management purposes
• Use the Service for commercial purposes unrelated to your wedding
• Attempt to access another user's account or data
• Interfere with the operation of the Service or its infrastructure
• Upload content that infringes the intellectual property rights of others

7. Your Content

You retain ownership of all content you upload to your wedding site (photos, text, registry items, etc.). By uploading content, you grant Tora Technologies a limited licence to store and display it as part of operating the Service. We will not use your content for advertising or share it with third parties beyond what is necessary to run the Service.

8. Guest Data

Guest RSVP information collected through your site is processed on your behalf. As the account holder, you are the responsible party for that data under POPIA. You agree to use guest information only for the purpose of managing your wedding and not to share it with third parties for unrelated purposes.

9. Service Availability and "As Is" Service

We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may perform maintenance that temporarily affects availability.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error free, or that any fault will be corrected. Nothing in these Terms excludes or limits any right you have under the Consumer Protection Act 68 of 2008, POPIA, or any other law where that right cannot lawfully be excluded or limited.

You are responsible for keeping your own copies of your data. You can download everything on your account at any time from the Download page in your settings, and we recommend you do so before your wedding date passes and before you close your account.

10. Termination and Data Retention

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms. On termination, your site will be taken offline and your data will be deleted within 30 days.

If an account is left unused, we eventually close it and delete the site and the data on it. We always email you a warning first. How long you have depends on the account:

• Paid account with a wedding date: a first warning two months after your wedding date, a final warning one week before deletion, and deletion of your account and your site three months after your wedding date
• Paid account with no wedding date set: a warning after 11 months without a sign-in, and deletion after 12 months without a sign-in
• Account where the publish fee was never paid: a warning after 5 months without a sign-in, and deletion after 6 months without a sign-in

We never delete an account less than seven days after the final warning email. Signing in resets the clock, and changing your wedding date moves the wedding date timeline with it.

Deletion is permanent. You can download everything on your account at any time from the Download page in your settings, so please keep your own copy of anything you want to hold on to.

11. Limitation of Liability

To the maximum extent permitted by South African law, Tora Technologies is not liable for indirect, incidental, or consequential losses arising from your use of the Service, including but not limited to: loss of gift funds due to gateway issues, loss of guest data, or inability to access your site. Our aggregate liability is limited to the amount you have paid us in the 12 months before the claim.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to account holders by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
